"We", "us" and "our" means 99Commerce Limited, a company incorporated in Hong Kong registered at Office Unit B on 9/F Thomson COmm Bldg 8 Thomson Rd Wan Chai Hong Kong. "You" means the person who buys a ticket or attends the event.
These terms apply to the Scaling or Failing BKK Mastermind in Bangkok, Thailand, on December 7 and 8, 2026, including any official side events, dinners and online content we provide with it (together, "the event").
By buying a ticket, registering, or entering the event, you agree to these terms. If you buy a ticket for someone else, you must make sure they know about these terms and agree to them.
You must be at least 18 years old to attend.
We run registration, ticketing and the event app through Whova, a third-party platform. To register, you will need to create a Whova account and follow Whova's own terms of use and privacy policy.
Please give us accurate, complete and current information, including your full name as it appears on your ID. We may ask for ID at check-in. If your details change, update them in Whova or email us.
Each ticket admits one named person. You may not share a ticket or a badge.
Ticket transfers and name changes, you can email hello@scalingorfailing.com.
We may decline or cancel a registration at our discretion, for example if the event is over capacity or if a person's attendance would conflict with section 7. If we do this before the event for reasons that are not your fault, we will refund what you paid.
Ticket prices are shown on our website. Prices are in USD and are inclusive of VAT and other applicable taxes.
You must pay in full at the time of booking unless we agree a different arrangement in writing (for example, an invoice for a group booking). Card fees or currency conversion charges from your own bank are your responsibility.
Your ticket is confirmed once payment clears and you receive a confirmation from us. Prices can change over time (for example, early-bird pricing ends). A later price change does not entitle you to a refund or a partial refund.
All ticket sales are final and non-refundable, except as described below.
Event cancellation by 99Commerce: If we cancel the event entirely, you will receive a full refund of the ticket price within 30 days.
Event postponement by 99Commerce: If the event is postponed, your ticket stays valid for the new date. If you cannot attend the new date, you may request a refund within 14 days of the postponement announcement.
Attendee cancellation: We do not offer refunds if you cancel, for any reason. This includes travel disruptions, visa issues, and personal emergencies. We strongly recommend buying travel insurance.
Ticket transfers: If you cannot attend, you can transfer your ticket to someone else until December 1, 2026. Email hello@scalingorfailing.com with the new attendee's name and email. Each ticket is valid for one named attendee only.
Refunds are paid to the original payment method. Nothing in this section limits any refund right the law gives you that cannot be waived by contract.
We are not in breach of these terms if events outside our reasonable control stop us from running the event or part of it, or force us to change it. Examples include natural disasters, extreme weather, flooding, fire, epidemics or public health orders, government action or travel restrictions, civil unrest, terrorism, strikes, power or venue failures, and the venue becoming unavailable.
If one of these events happens, we will first try to postpone or relocate the event, or move part of it online. If we have to cancel the event entirely, section 5 applies and you receive a partial refund of the ticket price [what is deducted from a force-majeure refund].
We want an event where people speak openly about what is working and what is failing in their business. That only works if everyone feels safe and respected.
At the event, at side events you agree to:
If you experience or see behaviour that breaks these rules, tell a member of our team at the event or email hello@scalingorfailing.com. We will handle reports discreetly.
We may refuse entry to, or remove, anyone who breaks these terms, Thai law, or venue rules, or whose behaviour we reasonably believe puts others at risk or disrupts the event. We may also deactivate their Whova access.
If we remove you for one of these reasons, you will not receive a refund, and we may refuse you entry to future events.
This event runs as a mastermind. Attendees and speakers will share revenue figures, margins, supplier details, failed launches, team problems and other sensitive business information. They do this because they trust the room.
By attending, you agree:
This does not cover information that is already public, information you already knew, or disclosures the law requires.
Please use judgement about what you share. We ask everyone to respect confidentiality, but we cannot control what other attendees do and we are not liable if someone breaks this section. Do not share anything that would seriously harm you or your business if it became public.
You may not record, livestream, photograph or transcribe any session, including slides and screens, without our prior written permission. This includes audio and video recording on phones, and AI note-taking or transcription tools.
Taking your own written or typed notes for personal use is fine.
If you record without permission, we may ask you to delete the recording, remove you under section 8, or both.
We and our contractors will take photographs, video and audio at the event. This may include footage in which you appear, including in the audience or in public areas.
By attending, you allow us to use that footage, including your image, name and voice, to report on and promote the Scaling or Failing BKK Mastermind and future 99Commerce events, on our website, social media, in advertising and in other media, without payment to you.
If you would prefer not to appear in promotional material:
We will make reasonable efforts to respect your preference. We cannot guarantee you will not appear in wide shots of the room, but we will not feature you prominently and we will remove footage of you from our own channels on request where reasonably possible.
We do not photograph or film confidential mastermind sessions unless we tell participants in advance.
Speakers and 99Commerce own the content they present, including slides, frameworks, templates, workbooks and recordings. Where we give you materials, you may use them for your own business. You may not copy, sell, publish, share publicly, or use them to train or teach others commercially without the owner's written permission.
The Scaling or Failing BKK Mastermind name, logos and branding belong to 99Commerce Limited. You may not use them in a way that suggests an endorsement or partnership without our written permission.
Speakers' views are their own and do not necessarily reflect ours.
Networking is a big part of this event. We want people to meet, swap ideas and do business. We also want everyone to have a good experience.
You agree not to:
One-to-one conversations where both people are interested are welcome. If someone tells you they are not interested, respect that.
You are responsible for:
Thai law may differ from the law in your country. Alcohol sales and consumption are restricted in some places and at some times. Vaping and e-cigarettes are illegal. You are responsible for following local law.
We may change health or safety measures at the event if public health guidance or venue rules require it.
You are responsible for your own belongings. We are not responsible for loss, theft or damage to personal property at the event, including items left in a cloakroom or meeting room, unless it was caused by our negligence.
You are responsible for any damage you cause to the venue or its equipment.
The event gives you information, perspectives and contacts. It is not legal, tax, financial or investment advice. What works for one business may not work for yours.
We do not guarantee any particular business outcome, revenue, profit or growth from attending. You make your own decisions and are responsible for the results. Take professional advice before acting on anything you hear.
We do not vet or endorse attendees, sponsors or the products and services they offer. Do your own checks before doing business with anyone you meet.
To the maximum extent permitted by law, 99Commerce Limited shall not be liable for any indirect, incidental, special, or consequential damages arising from your attendance at or inability to attend Scaling or Failing, use of this Site, or any event-related circumstances.
Our total liability to you for any claim related to Scsaling or Failing shall not exceed the amount you paid for your ticket.
Our full is the other tab of this dialog. Here is a short summary.
What we collect: your name, email, phone number, company and job title, billing details, ticket type, dietary and accessibility needs you choose to share, and information about your use of Whova. We also capture photos and video at the event (see section 11).
Why we use it: to process your ticket, run check-in and the event, send you event updates, keep the event safe, handle questions and refunds, meet legal and accounting duties, and improve future events. We will only send you marketing about future events if you have agreed, and you can opt out at any time.
Whova: Whova runs our registration and app. When Whova processes your data for our event, we are responsible for that data and Whova acts on our instructions. Whova also has its own privacy policy at whova.com/privacy, which applies to your Whova account. By default, your name and profile appear in the in-app attendee list so other attendees can find you. You can switch to "invisible" in the Whova settings at any time. Whova does not show your email or phone number to other attendees unless you choose to exchange them.
Sponsors: we do not sell your data or give sponsors an attendee list. A sponsor only receives your details if you choose to share them, for example by letting them scan your badge or QR code, exchanging contact details in Whova, or claiming one of their offers. Once you share your details with a sponsor, their own privacy policy applies to how they use them.
Who else we share data with: service providers that help us run the event (such as Whova and its payment provider, the venue, our photographers and our email tools), professional advisers, and authorities where the law requires it.
International transfers: we are based in Hong Kong, the event is in Thailand, and Whova stores data in the United States. Your data may be processed in these and other countries. We take reasonable steps to protect it when it moves.
Retention: we keep your data only as long as we need it for these purposes and to meet legal and accounting requirements.
Your rights: depending on where you live (including under Hong Kong's Personal Data (Privacy) Ordinance and Thailand's Personal Data Protection Act), you may have the right to access, correct or delete your data, object to or restrict some uses, withdraw consent, or complain to a data protection authority. To use these rights, email hello@scalingorfailing.com.
Hong Kong law governs these terms.
If you have a complaint, please email hello@scalingorfailing.com first. We will try to resolve it within 30 days.
If we cannot resolve it, the courts of Hong Kong have non-exclusive jurisdiction. This means you or we can bring a claim in Hong Kong, and nothing here stops you using the courts or consumer protection bodies where you live if the law gives you that right.
If you are a consumer, nothing in these terms removes any protection that the law of your country of residence gives you and that cannot be changed by contract.
We may update these terms, for example to reflect a change in law, venue or event format. We will post the updated version on our website and in Whova with a new "last updated" date, and email registered attendees about any significant change.
If a change significantly affects you before the event and you do not accept it, you may ask for a refund of your ticket price within 30 days of our notice.
